Privacy Policy

1. Scope of this policy

This Privacy Policy applies to the website at expressloans.com and related pages (the “Site”), operated by EJB SAS (“ExpressLoans.com”, “we”, “us” or “our”). It explains how we handle personal information when you use the Site or submit a loan-comparison request. It does not cover the privacy practices of the independent lenders, lending partners, or other third parties we connect you with — each of them has its own privacy policy that governs the information you share with or that is collected by them.

2. Information we collect

Information you provide. When you complete a request or contact us, you may provide identifiers and details such as your name, email address, phone number, postal address and date of birth; financial and loan-request information such as income, employment, the amount and purpose of the loan, and (where a lender or partner requires it) information such as a Social Security number or ITIN and bank-account details; and the content of any message you send us.

Information collected automatically. When you use the Site, we and our providers may collect device and usage information such as your IP address, approximate location derived from it, browser and device type, pages viewed, referring/exit pages, and similar diagnostics, through cookies and similar technologies (see Section 8).

Information from third parties. We may receive information about you from lenders and lending partners, marketing partners, analytics providers, and identity- or fraud-verification providers, which we may combine with the information you provide.

3. Sensitive information

Some information you provide — such as a Social Security number, ITIN, driver’s license number, or financial-account information — is treated as “sensitive personal information” under certain laws. We collect it only when it is needed to process your request and to pass to the lenders and partners who will evaluate it, and we use it only for those purposes and other purposes permitted by law. Where a law gives you the right to limit the use of sensitive personal information, you may contact us as described in Section 10.

4. How we collect information

We collect information directly from you (when you fill in a form or contact us), automatically (through cookies and similar technologies as you use the Site), and from third parties (as described in Section 2). Providing information is voluntary, but if you do not provide the information needed to process a request, we may not be able to connect you with lenders.

5. How we use information

We use personal information to: operate the comparison service and connect you with relevant lenders and lending partners; present and process your request; communicate with you, including service messages and — where permitted or with your consent — marketing (see also Section 7 of our Terms of Service regarding contact consent); operate, maintain, secure and improve the Site; perform analytics; detect and prevent fraud and abuse; and comply with legal obligations and enforce our terms. We do not make credit decisions, and we do not engage in automated decision-making that produces legal or similarly significant effects about you — lenders make their own decisions.

6. How we share information

We share personal information with:

• Lenders and lending partners — when you submit a request, so they can evaluate it and present offers. This is the core purpose of the Site.
• Service providers / processors — vendors that host the Site, send communications, provide analytics, and support identity and fraud prevention, acting on our instructions.
• Advertising and marketing partners — in connection with the cookies and technologies described in Section 8, which may involve “sharing” for cross-context behavioral advertising (see Section 7).
• Affiliates — companies related to EJB SAS, for the purposes described here.
• Legal, safety and compliance — when we believe disclosure is required by law or necessary to protect rights, safety, or to prevent fraud.
• Business transfers — in connection with a merger, acquisition, financing, or sale of assets.

We do not sell your personal information to unrelated third parties for their own independent purposes outside of connecting you with lenders and partners relevant to your request.

7. “Sale” and “sharing” of personal information

Because we may receive compensation when we connect you with lenders and lending partners, and because of how online advertising technologies work, our disclosure of personal information may be considered a “sale” or “sharing” of personal information under the California Consumer Privacy Act (as amended by the CPRA) and certain other US state privacy laws. The categories of information potentially involved are the identifiers, financial/commercial information, and internet activity described in Section 2, disclosed to the lenders, partners, and advertising partners described in Section 6.

Your right to opt out. You have the right to opt out of the sale or sharing of your personal information. You can do so by emailing contact@expressloans.com with the subject “Privacy Request,” by using our “Do Not Sell or Share My Personal Information” page, and by enabling a Global Privacy Control (GPC) signal in your browser, which we treat as a request to opt out of sale/sharing for that browser. Note that opting out does not stop the sharing necessary to fulfill a request you submit to be matched with lenders.

8. Cookies and tracking technologies; Global Privacy Control

We and our partners use cookies, pixels, and similar technologies to operate the Site, remember your preferences, measure performance, and support advertising. Some are necessary for the Site to function; others are optional. You can control cookies through your browser settings and, where offered, through our cookie controls. As noted above, we honor recognized opt-out preference signals such as the Global Privacy Control for the sale/sharing of personal information.

9. Your US state privacy rights

Depending on your state of residence, you may have the right to: know and access the personal information we hold about you and how we use and disclose it; correct inaccurate information; delete your information; obtain a portable copy; opt out of the sale or sharing of personal information; opt out of targeted advertising; limit the use of sensitive personal information; and not receive discriminatory treatment for exercising your rights. In some states you also have the right to appeal a decision on your request. These rights are subject to exceptions and verification under applicable law.

10. How to exercise your rights

To exercise any of these rights, email contact@expressloans.com with the subject “Privacy Request” from the email address associated with your information, and tell us which right you are exercising. We will take steps to verify your identity before responding, and we will respond within the time required by applicable law. You may use an authorized agent to submit a request on your behalf, subject to verification. We will not discriminate against you for exercising your rights.

11. Rights of individuals in the EU, EEA and UK (GDPR)

Because EJB SAS is established in France, the EU General Data Protection Regulation (and the UK GDPR) may apply to our processing. Where it does, EJB SAS is the controller, and our legal bases for processing include: your consent (for example, certain marketing); performance of a contract or steps taken at your request (to process your loan-comparison request); our legitimate interests (to operate, secure and improve the Site and prevent fraud, balanced against your rights); and compliance with legal obligations.

Subject to applicable law, you have the right to access, rectify, erase, restrict, and port your personal data, to object to certain processing (including direct marketing), and to withdraw consent at any time without affecting prior processing. You also have the right to lodge a complaint with a supervisory authority — in France, the Commission Nationale de l’Informatique et des Libertés (CNIL), or your local data-protection authority. To exercise these rights, contact us as described in Section 18.

12. Data retention

We retain personal information for as long as needed for the purposes described in this policy — including to provide the service, to comply with legal, tax, and recordkeeping obligations, to resolve disputes, and to enforce our agreements — after which we delete or de-identify it. The specific period depends on the type of information and the purpose for which it was collected.

13. Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit. However, no method of transmission over the internet or method of storage is completely secure, and we cannot guarantee absolute security.

14. Children’s privacy

The Site is intended for adults (18 years or older) and is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will take appropriate steps to delete it.

15. Third-party links and services

The Site may link to third-party websites and services, including lender sites, that we do not control. This policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to read the privacy policy of every lender or partner before sharing information with them.

16. International data transfers

We are based in France and serve users in the United States, so your personal information may be processed in the United States, in France, and in other countries where we or our service providers operate. These countries may have data-protection laws different from those in your jurisdiction. Where required, we use appropriate safeguards for international transfers.

17. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last updated” date above, and the updated policy takes effect when posted. For material changes, we will make reasonable efforts to provide notice. Your continued use of the Site after changes take effect constitutes acceptance of the updated policy.
